Overview of the areas in which a pre-emption right has been established pursuant to Article 34 of the Decree of 25 April 2014 on complex projects (Belgian Official Gazette 21/01/2015). The Decree on Complex Projects defines a ‘complex project’ as a project of major social and spatial strategic importance that requires an integrated permitting and spatial planning process. This decree lists a number of criteria that can demonstrate this great social and spatial strategic importance. The pre-emption right within these complex projects can be exercised in order to achieve a preferential decision or a project decision when selling a property that is located in the areas that are demarcated as areas where the right of pre-emption applies in the graphic plan or in the recognisable part that applies as a spatial implementation plan.
