The Decree on Spatial Planning of 18 May 1999 (hereinafter DRO) stipulates that the former system of regional plan changes and special plans of construction (BPAs) is replaced by so-called spatial implementation plans (RUPs). These plans are drawn up to implement the spatial structure plans and are therefore always drawn up based on the vision of such strategic policy plans. An RUP contains elements of destination, management and layout. This information is contained in urban planning regulations that apply to a piece of territory and therefore have a spatial link (whether or not parcel-related).Article 63 of the DRO provides that regional spatial implementation plans can designate zones where a right of pre-emption applies. This is also included in the urban planning regulations.Moreover, several authorities can be favoured. The spatial implementation plan thus determines the ranking.According to the DRO, RUPs are drawn up at regional, provincial and municipal level (Article 37). This dataset is currently under construction.
